These Terms govern your access to and use of the FerrySwap interface. FerrySwap is a non-custodial interface to a decentralized protocol. It never holds your assets and cannot reverse a transaction.
By using the Interface you agree to these Terms. If you do not agree, do not use the Interface.
These Terms of Service ("Terms") govern your access to and use of the FerrySwap website and interface (the "Interface"). These Terms are an agreement between you and the team that publishes and operates the Interface ("we", "us"). The Interface is proprietary software; it is not open source, and no licence to its source code is granted by these Terms or otherwise.
By accessing or using the Interface, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Interface.
FerrySwap is a browser-based graphical interface to Serai, a cross-chain decentralized exchange protocol. The Interface helps you construct and broadcast transactions to that protocol. It does not itself execute swaps, hold liquidity, set prices, or custody assets.
We may change, suspend, or discontinue the Interface at any time, in whole or in part, without notice. Because the underlying protocol is permissionless, the discontinuation of the Interface does not affect assets or positions you hold on-chain.
Network fees, protocol fees, and liquidity provider fees are charged by the relevant blockchain and by the Serai protocol. They are not set by us and we do not receive them. Any fee estimate shown in the Interface is an estimate only; the amount actually charged is determined at settlement by the network and the protocol.
You retain sole control of your assets and your private keys at all times.
By using the Interface, you represent and warrant that:
Access to the Interface may be restricted in certain jurisdictions. We reserve the right, but assume no obligation, to limit access from any territory.

Transactions settle on public blockchains. Depending on the network involved, information about your transactions, including addresses, amounts, and timing, may be permanently public and outside anyone's ability to delete or amend.
Different networks offer different privacy properties. Transactions on transparent chains such as Bitcoin and Ethereum are publicly visible and may be analyzed and linked to you. Transactions on Monero retain Monero's own privacy characteristics. We make no representation that any transaction is anonymous, untraceable, or private, and nothing in the Interface should be relied on for that purpose.
The Interface itself does not require an account and does not ask you for personal information. However, requests made by your browser to third-party endpoints (including RPC nodes, price feeds, and content delivery networks) may expose your IP address and other technical metadata to those third parties, whose practices we do not control.
The Interface may link to or integrate third-party websites, wallets, protocols, and data sources. These are provided for convenience only. We do not control, endorse, audit, or assume responsibility for any third-party service, and your use of one is at your own risk and subject to that provider's terms.
Nothing in the Interface or in these Terms is investment, financial, legal, tax, or accounting advice, and nothing is a recommendation to buy, sell, or hold any asset. You should consult qualified professionals before making any decision. You are solely responsible for determining and paying any tax that arises from your activity.
Nothing in the Interface constitutes an offer or solicitation to buy or sell securities, or an invitation to participate in any investment scheme. No representation is made that any asset accessible through the Interface is or is not a security or other regulated instrument in any jurisdiction.
The Interface, including its source code, design, layout, text, graphics, and the FerrySwap name and logo, is proprietary and is protected by copyright, trade mark, and other intellectual property law. Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Interface for its intended purpose. All rights not expressly granted are reserved.
You may not copy, modify, distribute, sell, sublicense, or create derivative works from the Interface, and you may not reverse engineer, decompile, or disassemble it, except to the extent that such restriction is prohibited by law. Third-party components, including the Serai protocol, remain subject to their own licences; third-party marks shown in the Interface belong to their owners and their appearance does not imply endorsement or affiliation.
If you believe material accessible through the Interface infringes your copyright, contact us on Telegram at @ferryswap with enough detail to identify the work, the material complained of, and your contact information. Knowingly making a material misrepresentation in such a notice may expose you to liability.
If you send us suggestions, ideas, or other feedback, you grant us an unrestricted, irrevocable, royalty-free right to use it for any purpose without obligation or compensation to you.
THE INTERFACE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by law, we disclaim all warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Interface will be uninterrupted, secure, timely, error-free, or free of harmful components, that any defect will be corrected, or that any information displayed, including prices, rates, and estimates, is accurate, complete, or current.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or digital assets, arising out of or relating to your use of or inability to use the Interface, whether based in contract, tort, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Interface will not exceed one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.
You agree to indemnify and hold harmless the team that publishes and operates the Interface, and its members, from any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to your use of the Interface, your breach of these Terms, your violation of any law or third-party right, or your negligence or misconduct.
If a dispute arises, you agree to first contact us on Telegram at @ferryswap and attempt in good faith to resolve it informally for at least thirty (30) days before commencing any formal proceeding.
These Terms do not designate a governing law or an exclusive forum. Questions of applicable law and venue therefore fall to be determined by the ordinary conflict-of-laws rules of the court seised of the matter. Nothing in these Terms limits any mandatory right, protection, or forum available to you under the law of your place of residence.
To the extent permitted by law, you and we each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
We may revise these Terms at any time by posting an updated version with a new "Last Updated" date. Changes take effect when posted. Your continued use of the Interface after that point constitutes acceptance of the revised Terms. If you do not agree, stop using the Interface.
We may restrict or terminate your access to the Interface at any time, for any reason, without notice or liability. You may stop using the Interface at any time. Provisions that by their nature should survive termination, including Assumption of Risk, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution, will survive.
You agree to comply with all applicable export control and sanctions laws, and you represent that you are not located in an embargoed jurisdiction, are not on any restricted-party list, and will not use the Interface in violation of such laws.
