• Network/gas fees are separate and not controlled by THORSwap.

• Does not provide financial advice.
• Is not an exchange, wallet provider, broker, or financial institution.
• Has no control over Digital Assets or third-party wallets.
• Is not affiliated with THORChain.

We do not guarantee uninterrupted service or protection from blockchain-related errors.

Digital Assets include, but are not limited to:

• Native blockchain tokens (e.g. RUNE)
• Tokenized real-world assets
• Crypto finance instruments
• Any tradable virtual currencies

To use THORSwap, you must:

• Be of legal age in your jurisdiction.
• Not be a citizen or resident of any Restricted Territory.
• Not be listed on any international sanctions list.
• Not act on behalf of restricted or sanctioned persons.
• Use only legally-obtained Digital Assets.
• Comply with all applicable laws and maintain private key security.

By using THORSwap:

• You consent to electronic agreements.
• You acknowledge these Terms are legally binding and enforceable.

By using the Site or Services, you agree to:

Legal Compliance

• Obey all relevant laws and sanctions.
• Avoid use for money laundering, terrorist financing, or illegal transactions.

Fraud & Misrepresentation

• Do not engage in fraud, scams, or provide misleading information.

Technical Conduct

• Do not disrupt or harm the platform (e.g. viruses, DoS attacks).
• Avoid excessive automated scraping or load.

Prohibited Activities

Tax Responsibility

Misrepresentations may result in liability for damages and attorneys’ fees.

Submitting a Counter-Notification:

If your content was wrongfully removed:

• Send your signature, a statement of good faith, and your contact details.
• Consent to U.S. jurisdiction and agree to service of process.

You must respond within 10 business days to restore content.

• Mandatory Arbitration: All disputes must be resolved through binding arbitration administered by the Singapore International Arbitration Centre (SIAC).
• Arbitration language: English

• Each party waives jury trial and class actions.
• If any part of this Arbitration clause is found invalid, the rest remains enforceable.

• THORSwap may update these Terms at its discretion.
• You will be notified of material changes via the Site.Continuing to use the Site after changes implies your acceptance of the revised Terms.

THORSwap does not recommend the value or fitness of any digital asset or third-party websites.

Technical Failures

• Software failures (e.g., wallet, smart contract)
• Delayed reporting by blockchain developers
• Material downloaded at user’s risk

You alone are responsible for protecting your data and devices.

Jurisdictional Limitations

Certain jurisdictions may not allow the exclusion of implied warranties. Some disclaimers herein may not apply to you depending on your location.

To the fullest extent permitted by law:

• THORSwap shall not be liable for indirect, incidental, special, or punitive damages.
• This includes, but is not limited to, loss of:

Maximum aggregate liability shall not exceed:

• (a) $100 USD, or
• (b) The amount paid by you to THORSwap in the last 6 months — whichever is greater.

• Fraud or intentional misrepresentation

By using the Site and Services, you accept and acknowledge:

• THORSwap does not provide financial, legal, or tax advice.
• Regulatory developments may negatively impact blockchain technologies.
• Prices of digital assets are highly volatile.
• Blockchain network congestion or outages may affect transaction cost/speed.
• You are responsible for understanding applicable tax laws.
• THORSwap does not control blockchain protocols and cannot reverse transactions.
• THORSwap is not liable for delays or losses caused by:
  
  • Force majeure events
  • Hardware failures
  • Security breaches
• Services are experimental and outcomes are not guaranteed.
• You are responsible for securing your own wallet and devices.

You agree that:

• You have sufficient knowledge to use these services.
• You release THORSwap from disputes between you and other users.
• You waive rights under any statute protecting unknown claims (e.g., California Civil Code § 1542).

To the maximum extent allowed by law, you agree to indemnify and hold harmless the THORSwap Parties (defined as employees, directors, affiliates, etc.) from all third-party claims, including but not limited to:

• Your use or misuse of the Site or Services
• Any feedback you provide
• Breaches of these Terms
• Violation of third-party rights
• Intellectual property disputes
• Tax obligations related to your use of the Services

You agree to:

• Promptly notify THORSwap of any claims
• Cooperate in defending such claimsAllow THORSwap to control the defense and settlement

This indemnity is in addition to any other legal obligations.

• Nothing on the Site constitutes a solicitation or offer to sell securities or investment products.
• Regulatory uncertainty may affect digital asset use and value.
• We may restrict access to users based on location, residency, or legal risk.

• These Terms are governed by the laws of Singapore, excluding its conflict of law principles.
• Any disputes not subject to arbitration shall be resolved exclusively in the courts of Singapore.

THORSwap may terminate your access to the Services:

• Automatically upon breach of these Terms
• At any time, with or without notice, for any reason

You agree that:

• No refund will be provided upon termination
• You will lose all rights to use the Services upon termination

If any provision of these Terms is deemed invalid or unenforceable, it will be severed and will not affect the remainder of the Terms.

You agree that a violation of these Terms may cause irreparable harm and that THORSwap may seek injunctive relief without posting a bond.

You agree to comply with applicable export regulations, including restrictions related to:

• U.S. embargoed countries
• Entities on U.S. Government restricted lists

By using the Services, you represent that you are not subject to any such restrictions.

Sections of these Terms that by nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, Governing Law, etc.) will remain in effect.

• These Terms are the entire agreement between you and THORSwap.
• You may not assign your rights under these Terms without written consent.
• No waiver of any provision is considered a waiver of any other provision.
• Headings are for reference only.
• The U.N. Convention on Contracts for the International Sale of Goods does not apply.
• These Terms are not intended to benefit any third parties unless otherwise stated.
